Chief Justice of India (CJI) DY Chandrachud has underscored the importance of balancing the search and seizure powers wielded by investigative agencies like the Central Bureau of Investigation (CBI) and an individual’s right to privacy. Speaking at the 20th D P Kohli memorial lecture in the Capital, the CJI called for upholding due process in criminal justice, stressing that this balance is fundamental to fostering a fair and just society.

CJI Chandrachud highlighted the need to avoid unwarranted confiscation of personal devices and urged probe agencies to exercise discretion in their investigative pursuits. He emphasized the significance of focusing on crimes that threaten national security, economic stability, and public order, urging these agencies to prioritize their efforts accordingly.

In an era marked by rapid technological advancements and evolving crime landscapes, CJI Chandrachud emphasized that investigative bodies like the CBI enhance their capacities and leverage tools such as Artificial Intelligence (AI) to address emerging challenges effectively.

Acknowledging the interconnectedness of digital technologies, he stressed the need for law enforcement agencies to adapt and innovate in response to new and complex criminal activities.

The remarks by CJI Chandrachud come at a critical juncture when concerns over privacy violations and the overreach of investigative powers have become increasingly salient. His call for a balanced approach underscores the judiciary’s commitment to safeguarding individual rights while ensuring the efficacy of law enforcement efforts in combating crime.

CJI Chandrachud’s remarks serve as a reminder of the ongoing dialogue surrounding the intersection of technology, privacy, and law enforcement. By advocating for a nuanced and principled approach, he reinforces the judiciary’s role in upholding constitutional values and preserving the integrity of the justice system in India.
